Terms of Service

You must be at least 18 years old (or the age of majority where you live) to make or receive payments on Kreoly, and at least 13 to hold an account. You agree to provide accurate information and to keep your account credentials secure. You are responsible for all activity that occurs under your account.

Kreoly has two main roles. Fans follow creators, subscribe to membership tiers, and back campaigns. Creators set up a public page, define membership tiers, publish posts and media, and may run crowdfunding campaigns. A single account may act in both roles. You may close your account at any time.

Creators offer free and paid membership tiers. Paid memberships are recurring subscriptions billed in advance on a monthly basis at the price shown at checkout, until cancelled. By subscribing, you authorize us and our payment processor to charge your payment method on each renewal.

You may cancel a paid membership at any time. Cancellation stops future renewals; your membership remains active through the end of the period you have already paid for, and is not prorated. Free memberships can be cancelled at any time and end immediately.

Creators may run “keep-what-you-raise” campaigns to fund a specific project. Pledges are one-time payments charged at the time you back the campaign. Creators are solely responsible for delivering any rewards they promise. Kreoly is not the seller of, and is not responsible for fulfilling, campaign rewards.

Payments on Kreoly are processed by Stripe, and your use of payment features is also subject to the Stripe Connected Account Agreement and Stripe’s terms. Creators receive payouts through a connected Stripe account and are responsible for providing accurate payout and tax information.

Kreoly charges creators a platform fee on paid memberships and campaign pledges. The fee is deducted from amounts collected before payout, and the current rate is shown to creators in the product. Card-processing fees are charged by Stripe. You are responsible for any taxes applicable to your earnings.

Except where required by law, payments are generally non-refundable. Because creators receive payouts of their earnings, refund and chargeback decisions may involve the relevant creator. We want Kreoly to be a safe, general-audience platform. Adult, sexually explicit, or NSFW content is strictly prohibited. You also may not post or fund content that:

• is illegal, or promotes or facilitates illegal activity;
• sexualizes minors or endangers anyone’s safety;
• is hateful, harassing, or incites violence;
• infringes the intellectual-property or privacy rights of others;
• contains malware, spam, or fraudulent or deceptive schemes; or
• violates the rules of our payment processors, including Stripe’s Restricted Businesses list.

We may review content and may remove anything, or suspend or terminate any account, that violates these Terms — with or without notice.

Creators retain ownership of the content they upload. By posting content, you grant Kreoly a worldwide, non-exclusive, royalty-free license to host, store, display, and distribute that content solely as needed to operate and promote the platform. You represent that you have the rights necessary to post your content and to grant this license.

You may stop using Kreoly at any time. We may suspend or terminate your access if you breach these Terms, if required to protect the platform, creators, fans, or our payment processors, or as required by law. Sections that by their nature should survive termination (including payment obligations, content licenses, disclaimers, and limitations of liability) will survive.

Kreoly is provided “as is” and “as available,” without warranties of any kind to the maximum extent permitted by law. We are a platform that connects fans and creators; we do not create or endorse creator content and are not a party to the relationship between a fan and a creator.

To the maximum extent permitted by law, Kreoly will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues. Our total liability for any claim relating to the platform will not exceed the greater of the amounts you paid to Kreoly in the three months before the claim, or USD 100.

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you, such as by posting the updated Terms here with a new “last updated” date. Your continued use of Kreoly after changes take effect means you accept the revised Terms.

These Terms are governed by the laws of the State of Arizona, USA, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Maricopa County, Arizona will have exclusive jurisdiction over any disputes, except where applicable law gives you the right to bring a claim elsewhere.
